But because there's no past precedence for something ('nothing on the books') doesn't mean something is legal either.

What you're saying is we'd be in uncharted waters with no precedence.

Correct.  Due to a lack of precedence it's wrong to call a potential federal mask mandate legal or illegal.   I've said this from the beginning.

But a surge in what?  Illness, or testing?  Reporting positives and comparing to other locations (e.g., per 100k population) is meaningless if the other locations aren't testing at comparable levels.  I'd put ND's numbers against anyone's so long as we're all willing to have a full and honest assessment with all cards on the table.

Soundbite journalism is going to be the death of us all.

North Dakota has far and away tested more people per capita than any other state...and it's not close.

And I think this is a good thing

To the last point.....if the data is used in context absolutely. Unfortunately it's not.

Even on here you have the ignorant and uneducated screaming "outbreak"!

"The Wall" is a foreign relations matter (the wall would go up between Arizona and sovereign Mexico, not Arizona and California).

Foreign relations is Constitutionally (Article II) the Federal domain.

Point is, Trump is superseding state and individual rights by defining the wall in terms of national security.  You think the NM gov wants a wall on state land?  Get real.   Any federal mask mandate would be done in a similar manner (national health emergency).

Same stick, different end.

RIP Justice Ginsburg

she really was a pioneer for women’s rights and a role model for many, whether we agree with her or not this is a huge loss for the country

Unbelievable. I don't care who you vote for. This is unacceptable.

There's no defending some of these people's attitudes and beliefs.

She seems really nice. This is similar to the weather ground BS.

She was a fixture on the court. This election just got more heated with her passing. Prayers to her and her family.

Not doubting we have tested more than most, but Rhode Island has tested more per capita.

But are these numbers counting all of the weekly tests ND long term care people have gotten that not every other state has done so well with? If so the numbers will be skewed.

Understatement.

Every Senate seat up for reelection will be under intense scrutiny this election.   for MN Smith VS Lewis will be interesting.

Damned if you do, damned if you don’t when it comes to filling the seat before inauguration. Piss your base off for not pushing a nominee through or piss off some moderates that want to wait to see who is elected. We all knew she hoped she would last until the next president took office., but now the opportunity has come where she could be replaced before the term is up. Sounds like Collins, Murkowski, and Romney are all signaling no votes before the next Congress. Seriously how the hell did we not banish Mitt from the party?!?!?

Any member with an ounce of integrity would not vote. McConnell set the precedent. Trying to fill the seat now that throws all of the "law and order" arguments out the door and would be the height of hypocrisy.

Covid is out the window.  Trump on the court.  Senators hide.  Both Dem and Rep.  Interesting times

This.

This is the #1 takeaway.

100% of the focus will now go to the fight for the nomination and vote.

RGB in death has done a great service to the country, she will have in fact cured the plannedemic.

2020 is full of what's next, still 3 months?

Trump and McConnell will start an additional rip into American politics with this one, could cost some incumbants at the polls in November.

More protests?

One thing we do know is Biden's list for a SCJ nominee can not be long. How many gay black females are out there to potentially meet the qualifications to get voted through? Under the current political,  racial and social climate what option does  he have left especially when pressured  from the AOC types.

Just went to a local grocery store. Masks not required. Two individuals walking in in front of me easily in their  late 70s......no masks. Table of 7 guys in little food area sitting around a table talking and drinking coffee. No masks. Not 6 feet apart. Definitely no goggles. Wish Redneksioux or Heydouch1 were there to shame them and tell them they are killing themselves.
