NCAA To Sanction UND if School Does Not Adopt New Nickname
fightingsioux4life replied to Benny Baker's topic in UND Nickname
Well Ira, I agree with all of this 1000% But you realize you will now get raked over the hot coals for pointing out inconvenient truths. Which truths, some will ask? These truths: That NDSU has overshadowed us to the point where a lot of people outside the Grand Forks City Limits don't even know we exist anymore. That our coaches salaries (outside of hockey, of course) are bargain basement laughingstocks. That too many of our fans and stakeholders think everything is just hunky-dory because we have REA and Men's Hockey and that nothing else really matters. That underachieving and even downright lousy coaches get way too much rope to hang their respective programs with. I am talking about Mussman and Jones in case anyone was wondering. That our AD has already stated in public, in the Grand Forks Heraldo, that there may be some cuts to the budget in order to fund FCOA for Men's Hockey and an equal number of women's scholarships. This is beyond unacceptable and if we go this route, we might as well drop down to NAIA.All of these things will not get fixed and will in fact get worse if the nickname debacle continues to drag on and on. Too many precious financial and human resources are being devoted to this issue and not enough to the issues I have laid out above. We can fight this losing battle or we can strive for, and achieve, excellence in all our programs. We cannot do both. -
Me either, a few years ago I called him Phil Load of Crap when he was getting beat over and over again. That said, I never like to see someone get injured like that. Get well soon Phil.

Yes, Teddy looks confident and sure of himself. Last year, he didn't have a reliable running game and the O-Line was okay sometimes and other times terrible. If those two things improve this year, look for Bridgewater to have a breakout sophomore campaign.

In all fairness, the "vikes" in bigskyvikes refers to the Minnesota Vikings. I might not agree with him on much, but I believe him when he says that.

Anyone else feel like we are having a lot of kids leave the team for one reason or another? It's not good for the program's depth.

Farmers will always need fertilizer and this is a big agricultural state. -

I think part of the problem is there was a fight over access to water for the plant. It involved someone complaining that the project would harm their private lake, which was man-made to begin with. You won't hear any of the stakeholders talk about it, but I think that is the real reason. I hope those people are happy and are enjoying their little lake on a hot day like this. The price was steep and will be paid by others. Anyone else hear something similar? -
Well, Red Sox fans had to wait 86 years between World Championships, so I guess I can wait a little longer for the Vikings to do it. And they finally have competent coaching and a competent front office making good decisions. We'll just have to wait and see what happens.

The Vikings are going in the right direction. A playoff berth would be a clear sign of progress.

Today is the 10 year anniversary of the NCAA's policy regarding use of American Indian nicknames during NCAA postseason events. On Friday, August 5, 2005, the NCAA announced the following: NCAA Executive Committee Issues Guidelines for Use of Native American Mascots at Championship Events 10 years and counting. And some people on here want to fight this to the death...no matter the cost.

NCAA To Sanction UND if School Does Not Adopt New Nickname

Which is why we cannot go without a name. I don't trust any of those suit-wearing fat cats any further than I could throw them. -
People used to complain about "those damn hippies"; now a lot of them are successful professional people. Today's hipster is tomorrow's accountant, lawyer, doctor, etc.

As for what to do with the old Hardees/Mia Mexico/Dickey's BBQ location, I think Grand Forks should put a cloverleaf interchange at Washington and DeMers on their transportation wish list. I avoid that intersection at morning and evening rush because of how congested it is. The Dickey's BBQ location (SE) is vacant, the NE corner is vacant, the NW corner is vacant and the SW corner has a Sinclair gas station, which could be bought out and relocated west of the cloverleaf on the north side of Demers. It could be the best addition to the Grand Forks street grid since the Columbia Road overpass.

Yeah, here we go with the Fargo is the Center of the Known Universe woofing again. Even Howard Stern will tell you that is not the case (and I don't even like Howard Stern). Grand Forks is a much different (and better) place than it was 20 years ago. The 1997 flood was a blessing in disguise, it forced us to reinvent ourselves. Now we have a large and prosperous (despite itself) UND, the new UAS tech park, the soon-to-be-built fertilizer plant, the UAS mission at GFAFB, continued Canadian traffic and more home and apartment building than any other time I can remember (and I have lived here since I was 3 years old). Go back to Bisonville and talk about how NDSU is just one step away from joining the Big 12 in all sports now that wrestling is there.

NCAA To Sanction UND if School Does Not Adopt New Nickname

Actually, CNN has turned into a milk toast network that tries to be all things to all people. And that doesn't work all that well in this era of 500 channels and audience fragmentation. -

And what would those be? Bringing back the Fighting Sioux name and logo and "accept the sanctions"? Have separate hockey jerseys that don't have the name and/or logo because regionals aren't held on-campus anymore anyway? Give a big FU (not a reference to that other school 75 miles away this time) to all the other sports we sponsor because they aren't played on ice? Are thoses the "ways out" you are thinking of? Sorry, that ship sailed a long time ago. We are coming up on 10 years of fighting this battle and we are still in the same place we were on August 5, 2005. When is enough enough? -

And we have yet more cherry picking. -

Because a legally-binding agreement says so. That trumps any quotes or press clippings you post on here. The last thing the NCAA will tolerate is the Fighting Sioux name and logo living on as an "unofficial" nickname. They are not that stupid. Misguided, yes. Stupid, no. -

Man, you are cherry picking more than Dave Spehar did for the Gophers back in the day. -

Okay, enough of this bickering over what the legal documents say or don't say. I have taken the time this evening to look up both legal documents in question (both easily obtainable via Google btw). Subsection 2(d) of the 2007 Legal Settlement between the State of North Dakota and the NCAA reads, as follows: Please note the highlighted and italicized sentence above: It clearly states that UND must adopt a new nickname and logo or go back on the naughty list. The date was obviously screwed up by Al Carlson and the Legislature's clumsy attempts to save the name and logo. Subsection 2(f) discusses the Native American imagery in REA and BESC and how that impacts UND's eligibility to host NCAA championship events. That subsection was revised in the much referenced September 2012 Addendum to the original Agreement of October 2007. I have included the sections most pertinent to the question at hand: Section 1 offered more detail on which parts of REA and BESC need to be changed immediately and which parts can be replaced in the general course of maintenance. This detail was not present in the 2007 Settlement Agreement and thus was spelled out in the Addendum. Section 3 spells out that UND is off of the naughty list if it hadn't already been removed from the naughty list (this was after the nickname law was killed off for good in June 2012). The part of Section 3 that some people are forgetting about is bolded and italicized as follows: provided the University remains in compliance with the terms of the Settlement Agreement and this Amendment. Based on what is in the Addendum, there is nothing in the Addendum that nullifies or changes Subsection 2(d) of the 2007 Settlement Agreement, only the aforementioned Subsection 2(f). Consider the timeline of events that follows: The transition to a new name and logo technically started on December 1, 2010, after Standing Rock refused to let their people vote on this issue. Then the 2011 Legislature passed a law enshrining the Fighting Sioux name and logo into State law. A last-ditch visit to the NCAA in August 2011 prior to the aforementioned August 15, 2011 deadline failed to change their position on the name and logo. Thus, UND went back on the naughty list on August 16, 2011. The North Dakota Legislative Redistricting Session passed a repeal of the nickname law on November 7th, 2011 (SB 2370). The bill also included the "cooling off" period expiring on January 1, 2015. UND comes back off the naughty list. Then SB 2370 was referred to the voters for the June 2012 Primary Election. UND is back on the naughty list. In June 2012, the State of North Dakota voted by a 2 to 1 margin to uphold SB 2370 and to proceed with the retirement of the Fighting Sioux name and logo in that election. Shortly after that, President Kelley resumed the previously aborted retirement process of the old name and logo and the process of transitioning to a new name and logo. The Addendum Agreement was signed by the State of North Dakota and the NCAA in September 2012, which also ensured that UND was off the naughty list again in recognition of the June 2012 election results and UND's subsequent resumption of the retirement/transition process. So, from December 1, 2010 until right now, UND has been engaged in an on-again, off-again transition to a new name and logo. It is highly unlikely that the NCAA would raise a stink about UND not yet having a new name and logo in place with all the disruptions and micromanaging that UND has been subjected to over the past 5 years. However, if we make it clear that we are not adopting a new name and logo, the NCAA will likely point to this as a violation of Subsection 2(d) of the 2007 Settlement Agreement and then announce that we are back on the naughty list along with Alcorn State. This is what is at stake during the next several months and why "UND/North Dakota" is simply not a feasible option. -
Which are being pushed by the No Nickname and Sun Dog camps...for different reasons. Politics make strange bedfellows and this is another example of that.
