  1. On a somewhat related note, NBC Sports had a wonderfully slavering look at the "greatness" of Notre Dame hockey last night. You'd think they were UND, or even Minnesota.

  8. I was part of a study group formed by the NC$$ to ensure that no group of thin-skinned, bed-wetting individuals would be excluded from its crusade to cleanse "insensitivity" from the land. So, naturally in the spirit of comradeship and good faith, I decided to help our mentally deficient friends from 'su see the error of their hateful ways.

  12. Even assuming SL and SR gave their consent now, or in 2007, what's to prevent them from pulling it at some point when the tribal winds change? They're sovereign nations. What would Clueless Al and some others do? Sue them? Trot out a few petitions? Write an angry "expose" on Say Anything?

  15. I wouldn't call those people "stakeholders". They only have a "stake" in the Sioux moniker, not the university itself. UND can't really control its own moniker as long as certain people insist on treating the issue as a political one. That goes for Clueless Al, and his equally clueless acolytes passing out petitions, etc.
  16. In my own case, I've increased my own kick to UND, and the employer match. I would expect some run-off. However, I think most alums and others who hate seeing the moniker go will still contribute as they see their money benefitting the school as a whole, and not the NC$$ or some other political hacks.
  17. "LSU" = "Louis' School of Undertaking" .. Frankly, watching Alabama beat LSU was a bit of a snore for two "top tier" programs.

  19. Even companies that file publicly with the SEC report material pending litigation that may impact their businesses. I'm especially surprised they didn't report the anti-trust litigation regarding former players' likenesses and the putative class-action involving players' concussions. As for SL, I'm not sure their lawyers would consider it "material" at this stage, regardless of the local histrionics. However, given the NC$$' own business practices, they won't report litigation like that unless so compelled by their membership or the feds.
  20. I I wonder about Attorney Soderstrom's role in this. On one hand he's representing SL's attempt to gain rights to the Sioux moniker, and on the other he's pushing signatures that would take away that right.

The problem I see with the 'state actor" designation is that it may give the NC$$ immunity from certain types of claims, like anti-trust, and give them a degree of legitimacy afforded to regulatory agencies, e.g., deference of the courts, administrative discretion, etc. I'd rather the NC$$ be pillioried and exposed in front of a Congressional committee on C-SPAN than giving them any governmental platform to make and enforce rules at their own whim.
  22. It would raise some interesting issues if somebody claimed "Sioux suck" is "hate speech", and possibly subject to a school's own Code of Conduct ...
  23. Agreed. Basically a case of "we told ya so" by the local media, while quietly trumpeting the demise of the Sioux moniker at UND ...
