The State is out of options. In signing the settlement agreement the State gave up the right to sue the NCAA again. The Gophers play Illinois because Illinois is not under NCAA moniker sanctions. The key isn't the name, it's whether or not the school is under NCAA sanctions for the name.

There's a way to keep the name, but as Dave Hakstol said, keeping the name guarantees a slow degradation of all of UND Athletics, including mens hockey. And when Athletics is dead and gone, so is the moniker. So guess what: No matter the outcome of the vote the moniker is dead. It's just a matter of when do we close the casket.
