I must say, very astute observation.

Honest answer: who knows. Honest assessment: Leaving a void leaves UND open to second-guessing by the NCAA . Best guess: If UND can say "we've done everything in out power, new name, new logo, new merchandise" what more can be asked of them?

'Best practice scheduling' in a nutshell: Don't schedule teams that are on our (the NCAA's) < bleep > list. Fans will cheer what they know and what fans know changes over time. Look at GFC, or Devils Lake, or Wahpeton, or IUP, or Arkansas State, or Stanford, or Dartmouth.

I'm smiled and laughed when I read your comment. (I knew you were poking for fun.) It fit with Commandment Two (and I do try to follow those Ten). Marcinko left the military and had a pretty successful business career with those Commandments. Dr. Kelley could learn from Commandment One. Commandments Four through Eight are good advice to anyone.

I'd suspect using this reference, that any school listed that changed on or after 2005 fits your category. My guess? Same as if the nickname hadn't changed (up to and including the NCAA sending their "best scheduling practices" recommendations out again to NCAA schools and conferences as they've done in the past).

The "death penalty" is a by-sport penalty (see: SMU football). What do you hit with that at UNC? The issues seem athletic department wide. RE: Penn State - I never understood why the NCAA got involved in that one. That was a criminal matter. I would have liked to have seen a few more PSU officials in handcuffs for conspiracy (the cover-up of the crime).

You're right. The bluff is by the "no nickname" folks: We're fine without a nickname (but we'll keep wearing the old nickname). The NCAA (per Goon, and now GFH) seems more than willing to call that bluff with their "no nickname is fine if you're serious; but, if we hear complaints about hearing too much of the old nickname we're coming back at you" stance. I'm willing to say the NCAA is not bluffing on that. Why? It's the same approach they took last time, namely, you can have any nickname you want, but if it's the wrong one in our minds we're coming at you.

Last time UND tried to call the NCAA's bluff, UND lost a nickname and as a bonus the NCAA Executive Committee got a whole new set of powers to make up stuff as they go.

Californians? No. The folks at the table opposite the NCAA were the folks from the Spirit Lake Committee for Understanding and Respect. Now unless Spirit Lake Nation moved and nobody told me ... As far as the pipe ceremony, Judge Erickson gave it all the weight he could.

The free speech aspect of this is a non-starter. The NCAA is a private club. They can make up "club rules" as they go, and as a private (not public) entity they are not bound by the First Amendment.

If it wasn't them, who was sitting at that table in Federal Judge Erickson's court room? Sure looked like Archie and Eunice. Thank you for the offer, but I don't need your book. I watched the procedings in person in the court room. Judge Erickson ruled that they have no standing in the relationship between the NCAA and UND. You could see (UND graduate) Judge Erickson had sympathy for them and some concern about the "prudence" of the NCAA policy, but he also stated even if they had standing much of their case would struggle to show merit.
