Sorry, I'm a bit of a smart ass.

Isn't it odd that even supporters of the name "Fighting Sioux" will be inclined to vote against the name to save UND's athletic department? So, if the vote total comes up negative against the law, it will appear to outsiders that North Dakotans are against the nickname. Even those (like myself) who are hoping that the SL Tribe's lawsuit against the NCAA is successful. A negative vote could hurt the people who hope to win that lawsuit. This is messed up.

Just voting on this is a mistake, IMHO.

I can't remember who said it on another thread, but it *IS* time to put a tent on this circus!

This is messed up.

Like I said somewhere else, this has made some strange bedfellows.

REA was suiting to keep "save the name" petitions off their site.

Long time Sioux fans will be voting to retire the name to protect UND

I think UND needs to come out with tv ads and in the media to broadcast the dangers of keeping the name. Have O'Keefe, Kleinsasser, Phil Jackson. High profile alumns come out and say "retire the name". Show UND losing playoff games on the road, show them in their green road "North Dakota" hockey jerseys from 1993(I believe) as that will be a reality if the name stays. We need to educate the state why the name needs to be retired. Show UND vs Minnesota and Wisconsin and how not playing them ever will be an empty feeling.

Quite certain that it would have to be someone else taking the lead on this. I don't think that UND can spend money politically lobbying on a constitutional amendment. Or at least spend taxpayer money on it.

Waiting for a June election might be waiting too long.

This has to get into and back out of the Supreme Court a.s.a.p.

From the GF Herald article it sounds like they are going to ask that the matter goes directly to the Supreme Court, rather than to the District Court first. And they are going to ask for an expedited process so that the decision is made before the June ballots are printed.

Could'nt they do that for SL's case too ?

The SBoHE is suing on a State issue in State court.

SL is suing in Federal court. Different process. Different rules.

and then there will be appeal after appeal?

Doubtful. SL doesn't have the NC$$'s money, or much of the law on their side. Then again, litigation can be a real crap shoot.

and what if the supreme court finds keep the name is unconstitutional? Will there be appeals?

I don't think so. The ND Supreme Court would have the final say in what is constitutional in North Dakota, just like the U.S. Supreme Court has the final say in what is constitutional for the U.S. as a whole.
