College football has always been a land of "haves and have nots", especially since TV money has been pouring into the mix. This move just formalizes the structure, and saves the NC$$ the embarrassment of losing the B5 entirely. That said, the coming "arms race" for players, facilities, money, etc. will probably force some schools to drop programs, conferences, etc.

Whole Foods looks at the overall demographics of an area, as well as how it can source locally grown organic produce and meats. For example, Des Moines just got a small one a couple of years ago, so I doubt Fargo would be on their radar anytime soon unless WF really wanted to increase its footprint. The fact you have roughnecks making over $100K and living in $3000 apartments may not be enough to drive them unless Williston also develops a larger white collar population who would be amenable to spending more there than at CashWise.

Part of the problem with the federal law argument is that the Lanham Act generally provides protection only to tradmarks that are registered or in the application process for registration. It's been a number of years since i've looked at the Act, but that's my basic recollection, and that discrete protection creates the incentive to register trademarks at the federal level. So the NFL and Snyder may be left to fighting it out in a variety of state courts where state laws may also prohibit protections for "disparaging" marks. I agree the "fat lady" hasn't sung, but if the DC trial and appellate courts follow the USPTO lead, it creates a bit of challenge for Goodall et al. from a litigation perspective as well as a "reputation" perspective.

The cynic in me would suggest that removing trademark protection may actually be counter-productive to the plantiffs' stated goals especially if there is a flood of "Redskins" merchandise unleashed into the market. Then again, that's just me thinking out loud.
