The argument isn't about whether free speech is protected everywhere in all situations. Obviously, it isn't. If I'm offended because you fly the American flag on your front lawn every day, I don't have the right to force you to take it down. If you're offended because I burn the American flag on my front lawn every day, you don't have the right to stop me from doing that. Get it?

I'm no lawyer, but I seriously doubt that there's any way Toews could win a libel suit without proving that the Herald knowingly and maliciously published false information about him. It could also be argued that Toews is a public figure.

That was defintely some sloppy reporting. There's no excuse for it. Yes, I've certainly made my share of mistakes over the years, but on a story that's been this big in which people's reputations are involved, you owe it to them and to your readers to get it right the first time.

I don't need your pity or your rationalizations. All players -- U.S. and Canadian -- know what the legal drinking age is when they come here to play hockey. If they choose to violate the law, then they better expect to suffer the consequences of getting caught. It's their choice. It's not out of their control.
