  2. Which will effectively mean "jack squat" to the NC$$. A constitutional amendment by any state only has the force of law within its borders. They understand that concept, and seem perfectly comfortable to watch the legislature, the Board, etc. spin their collective wheels.
  3. I'm sure SMU thought the same thing. If anything, considering all of the "negative" attention surrounding the NC$$, they may look for a high-profile "example" of how tough they can be.

  7. Microsoft was found to be a monopoly in the US and EU for certain products, even though it has/had a myriad of competitors. "Monopoly" does not necessarily mean a complete lack of competition, so much as potential abuses of market power by a dominant player(s). Just ask Google.
  8. Based on a case the Supremes heard yesterday, that kind of argument may actually have some traction. While this case largely concerned privacy issues, it also brought out First Amendment protections of commercial speech. NY Times
  9. My concerns about making the name subject to the ebbs and flows of tribal poltiics notwithstanding, I never understood the "two tribes consent" requirement. At the very least, I believe the Board should have been able to negotiate the same level of consent as was afforded to Florida, Utah, etc. Then again, both states' congressional delegations got on the NC$$ almost immediately. NoDak? Never a word from anybody. I think the only Congressman who wanted to push the NC$$ was from Illinois(?) and he lost the following election. You would think at least one of the current crop in NoDak's DC crew might be amenable to pushing the NC$$ into opening its kimono, on this and other issues. Until Capitol Hill starts picking on the NC$$, they'll basically laugh at some smallish state in "flyover country".
  10. I think you would have to at least get NoDak's current congressional delegation on board first. And we've heard nary a peep from them over the past few years. Perhaps they would be willing to expend some political capital for the people at home, rather than the K Street crowd. It's one reason the NC$$ probably views the state legislation as little more than a joke. Get them looking at Capitol Hill, and vice-versa, and they may reconsider their recent brush off.

  12. I'm surprised they even agreed to meet in the first place, especially in NoDak. I presume their lawyers pulled the Prez aside, and pointed out the open meeting laws, as well the constitutional mess the legislation caused. Why get involved in somebody's family feud? They can sit back and see how that unfolds, and they're still holding the best hand at this point.
  13. No, but they can still treat UND like a "red headed stepchild" for not toeing the line, which could have adverse consequences for student-athletes, and affect possibly affect recruiting and/or conference affiliations down the road. Never underestimate the vindictiveness of a monopoly ...
  14. The NC$$ has no reason to lift a finger to help UND. As far as they are concerned the matter was settled when Judge Jahnke signed his order. And their lawyers will probably tell them, if they haven't already, that any further meetings on the issue are unnecessary. At the very least NoDak's open meetings laws probably would not be conducive to any further discussions outside of litigation.

  16. Newark? That city makes downtown Kabul seem peaceful. People only drive in for the Devs' games, or to use the airport, and then drive (fast) back to East Orange or Jersey City. However, I do agree that a FF just seems out place in Tampa.

    Good thread idea. It was nice to see Scotty Sandelin win a Title. UMD has always been one of my favorite non-UND hockey programs. Congrats to them, and it was so nice watching Michigan lose.

  24. Check out HBO's recent spot on the NC$$ dealing with its concept of amatuerism. HBO The NC$$ could care less about Bismarck. If the NoDak congressional delegation in DC had its act together we might get a different result, witness what happened with Florida State and Utah right after the H&A list came out. People are wasting their time directly emails and calls to Bismarck. Call DC.
