  3. Both BG and Tech have at least one Title, and NC$$ tourney wins. Then again, "participation" seems to be SCCC's forte, as evidenced by all of the banners in the rafters. I haven't been to the NCC for years, do they still hang banners from local businesses to cover the concrete? As a practical matter, given former-President Saigo's campaign against the Sioux name/logo, if UND never played them again in any sport it would be too soon. I see no reason to drag that albatross into a new conference of any stripe.

  5. I doubt Carlson's idiocy has much to do with UND per se, so much as the constitutionally protected Board. Cluess Al used UND's name/logo as a strawman in an attempt to grab vested authority from the Board. Now that he's been slapped down, he refuses to get out of the way and keeps acting like a spoiled a$$clown. Again, where was he in this fight 4-5 years ago?

Laws that ban texting usually have a penalty provision, such a ticket, fine, etc. built in to show people that the legislature did "mean it". People ignore speed limits, and some end getting tagged for it, as provided in the law. Carlson's failure to include a penalty provision or some other enforcement component is his own damn fault. Beyond its place in the North Dakota Century Code, his legislation has that same force as one that recognizes a state flower or designates an "official" septic tank.
  8. Really? I don't recall seeing a private right of action in the legislation, nor do I see any other enforcement mechanism. Just because a law is "violated" doesn't mean some private citizen, or butt-hurt legislator, can unilaterally move to enforce it. The only person who can really do anything under the law is the AG, and that's only explore the possiblity of legal action against the NC$$.

  10. I agree. Carlson reminds me of a child who's beating his little fists on the floor to get some attention. People in his district should be ashamed of him and the mess he created, and refuses to help clean up.

  16. Perhaps in the short term. Over time, any "lost" revenue from Sioux gear will be made up by those who buy the new stuff. Unlike a few people around here, most people who support the name also support the school and many will probably end up buying new stuff eventually. Or their kids will when they hit campus and there's no alternative.

  18. Of course, Clueless Al won't sponsor a reversal of his legislation. It was nothing more than a blatant attempt to undermine the constitutional authority of the Board. Clueless Al can shake his tiny fist at the NC$$ and laughably wax poetic about his "principles", but this stunt was really nothing more than a power grab that put UND into one helluva corner.
  19. No, the board will have to "man up" and first retire the name/logo to avoid the NC$$ sanctions, and possible denial of the BSC membership. Let Clueless Al try to "enforce" his own law, on his own dime.
  20. We should form a venture to buy up all of the licensed Sioux gear available. Once the name is announced and marketed, we could sell the Sioux gear at a premium to those who would never buy the new stuff.
  21. There are no criminal penalties or private rights of action in Carlson's law. The Board could just decide to disregard the law, retire the name and wait to see what might happen. I'm not sure anybody has the stomach for a consitutional fight on this law, and I'm pretty certain the law would be bounced by a court anyway. Conceivably, the only person who has any "enforcement" obligation is the AG, and it's more discretionary than mandatory as it relates to determining if the NC$$ could be sued. As I noted previously, the AG is hopelessly conficted in this matter, and his silence may be a testament to that conflict.

  24. Precisely. Stenjhem et al. negotiated the settlement agreement. Kelley wasn't part of that process. He was handed this mess and has done an okay job of trying to handle it. The name/logo were effectively killed off in 2007, and it's time to bury them.
