  1. Some of us have read it -- and understand it. The Supreme Court ruled on the narrow question of whether the board of higher education had the authority. Most people would agree the board does. However, the court did not address the extent of the legislature's authority with respect to this issue. While it is true the board of higher education has some degree of constitutional status, the board is not a fourth branch of government that is allowed to operate in a autonomous manner. Read section 26 of article XI of the state constitution -- Section 26. The legislative, executive, and judicial branches are coequal branches of government. Learned that in grade school.

  16. From today's Bismarck Tribune. Pigskin talk U-Mary is hoping to play an evening home football game on Aug. 25 or Sept. 1. Athletic director Al Bortke is shooting for the Aug. 25 date to complement freshmen orientation. The school is looking into four options in picking up a game. Bortke said U-Mary's first choice is to schedule a game with Augustana College (Sioux Falls, S.D.). To make that possible, Augustana would have to schedule a Wednesday, Friday or Saturday game with Concordia-St. Paul. U-Mary's second choice is to schedule a game with Minnesota-Duluth, but traveling to Bismarck might be an issue with Duluth. Bortke said scheduling a game with the University of North Dakota or Minnesota State-Mankato could be an option. Bortke said Mankato is looking for a home game. A game with UND might be a way for the Sioux to let Bismarck native Weston Dressler showcase his talent in his hometown, but nothing has been finalized with UND. A high school football jamboree has also been scheduled for Aug. 25 at the Bismarck Community Bowl. Bortke has made contact with Bismarck Public Schools athletic director Jim Haussler to see if they can work together on that day. Again, nothing has been finalized.

A person commits computer crime by intentionally and either in excess of authorization given or without authorization gaining or attempting to gain access to, altering, damaging, modifying, copying, disclosing, taking possession of, introducing a computer contaminant into, destroying, or preventing the authorized use of any computer, computer system, or computer network, or any computer software, program, or data contained in the computer, computer system, or computer network. A person who commits computer crime is guilty of a class A misdemeanor. 3. In addition to any other remedy available, the owner or lessee of a computer, computer system, computer network, or any part of the computer, computer system, or computer network may bring a civil action for damages, restitution, and attorney's fees for damages incurred as a result of the violation of this section.
