  6. That's not true. The NCAA can't ban black men from trying out for sports, or do other things that violate equal protection or other civil rights. But in this case they seem to make a distinction between Fighting Sioux and Fighting Irish, which is illegal. Note also that they aren't really a private organization, as they're run by mostly state actors (i.e. public universities). Leaving the NCAA because one believes they're violating equal protection civil rights isn't a reasonable response.

We don't know what kind of support they need to meet the supporting tribe requirement - perhaps they already have the support they need, or have an agreement with a Sioux tribe in the works that will satisfy the requirement. If they can negotiate their way into keeping the name, it's going to be much cheaper than fighting in court over it for the next three or four years, and probably faster, too. I still think there's a cause of action under equal protection in federal court if they want to keep the name, and people other than the university could reasonably have standing to sue. I strongly doubt that the NCAA, made up of mostly public university member institutions, isn't a state actor for equal protection purposes... John

  10. The bridge as it was built in 1967 would never have been built today - engineering standards have changed significantly. It's odd to think we didn't have a solid understanding of how to build a very safe bridge until the 1970s, but research done then at Lehigh, I believe, forms the basis for most bridge design today. I parked under that bridge every day for three years when I was in law school at the U of M, and always intentionally made sure I was under the bridge so my car wouldn't get snowy or wet and would be in the shade. It seemed like a good idea at the time...

    You don't necessarily need "real" malicious intent for libel. If the reporter knew the information was false, or published the information with reckless disregard for the truth despite not having actual knowledge it was false, she can be guilty of libel. Standards vary, and although I am a lawyer (and played one on TV once), this shouldn't be taken as legal advice. John

  14. But if the Sioux score again, they'll be ahead by two goals which is the most dangerous lead in hockey according to Mazocco and Woog. I'm trying to understand the relative safety of a one goal lead, but for some reason I'm still nervous...
  15. Thanks guys - I did the basic jersey design, and they were made by Chris at Gemini Athletic Wear in the Twin Cities - the same guy who designed and made the last two Sioux jerseys. The quality is amazing - I can definitely recommend them to anyone needing jerseys for any kind of hockey team. Although I'd hate to give up my logo to UND I could probably be persuaded, but it's not my favorite of the new nickname choices. It made more sense for my team, as we're all pretty much snow-covered by the end of a game. John

  17. I still like Fighting Cavalry if it gets changed - it has a strong tie to the state's history, and is perfectly appropriate. Or, we could give a nod to Johnny Cash, and be the Boys Named Sioux...

  21. Not exactly bitter, but the Sioux lost in the NCAA championship game in '01 and in '05, and had pretty good teams in between with players like Parise and Bochenski woh didn't quite get there. I imagine more than a few Sioux fans have wondered how many national titles might have been won if the Potulnys and Irmen had been playing for the Sioux instead of Minnesota. We wouldn't be jealous if they weren't good players. John
  22. It sounds like six minutes to go in the second, Sioux up 3-0. I suppose it would be nice if those following on radio or netflix updated score and time at least once or twice a page...

    How is the score of some random game worthy of it's own thread title mid-game (even if scored by a couple North Dakotans)?
