If it was a bad stop, the Judge would have tossed the evidence at a prior hearing. You never know what a jury will do. Most good defense lawyers can argue until they are blue in the face that the intoxilizer machine is faulty (assuming a breathalyzer was done instead of blood). Some juries are gullible enough to believe this.

As a NDSU supporter this is not necessarily over for me. I agree there there will not be any criminal charges to come out of this, but that does not make it right. Why should additional oversight be needed? There were dozens of very smart people involved in the house process, what would adding additional people do? The end result of this mess is likely going to be reduced revenue for the Foundation. I cannot imagine some of the big contributors were happy their money was going to slush funds, two sets of counter tops and ripping out a driveway because of some saw lines.

The bonus room. The backyard bathrooms. The fast track completion date. Ya he had nothing to do with it. I suppose he is going to toss his wife under the bus now. My favorite story of the mansion saga is where a contractor cut loops into the driveway for the security gate (loops are electronic sensors placed in roads, typically to be used for traffic signals - this is how the light "knows" someone is waiting). When Mrs. Chapman saw the marks where the concrete was cut out she made them tear out the concrete and re-pour it so there were no visible lines. This likely cost $10-15K.

The only way you could tell a difference is on a blue ray (or some video games). HD channels are mostly in 1080i (not 1080p), which are converted to 720p in 720p and 1080p televisions. So getting the 1080p makes no sense unless you watch a lot of blue ray movies. 720p sets appear to be getting fazed out though. I suppose 1080p sets do not cost much more to make, but retailers make more on them. Everything I have read and been told is that television will not be going to 1080p anytime soon because of the extra bandwith needed, not that i have any clue what that means. My plasma is in my basement, which has an egress window, but still does not let in too much light, so glare has never been an issue for me.

I bought my plasma from Team Electronics in Fargo. They matched the cheapest price I could find on the internet (which was much less than I could find at any box store including Sams), installed it for cheap and were much more knowledgeable than the pions at Best Buy. I have a 50" Panasonic and really enjoy it.

I hope NDSU has equally good insurance because I imagine there will be a dispute over allocating fault. If for some reason this was all M-J's fault (unlikely) and this was to put them of business (unlikely), I am sure a surety bond was required to bid the job. Like most accidents this will likely be mostly paid by the insurance and/or bonding companies involved.

I am surprised to see Phaneuf left off the team. Given the Olympic ice and rules I can see going with some quicker D, but Phaneuf has been one of the best NHL D man the past couple of years. After watching this years World Junior games it is tough for me not to say F Canada and hope they end up w/out a medal.

Ah yes, that would have added to the problem. I would love to meet the contractor that can make the building usable in two weeks. Fortunately, NDSU has a $2 million building not far from Minard that is currently sitting vacant. I am sure the dining room would make a great lecture hall.

The building was closed for renovation, which likely caused the collapse. I would hate to be the contractor doing the remodel. Actually I would really hate to be the bonding company for said contractor. Fortunately the gas had been shut off, otherwise this could have been really ugly. The quote that the building should be ready when students come back January 11 is pretty interesting. You do not need to be a structural engineer to realize it is not possible to repair this kind of damage in two weeks. One side of the foundation is destroyed. I would question whether the building can be saved. I spent a lot of time in Minard Hall during my NDSU days. I hope it can be repaired.

Apparently most of the students at NDSU don't pay tuition, so why bother with scholarships . Collections? When I was in college (not that long ago) you paid your tuition or you were dropped from your classes. Has something changed? "After reviewing the details of NDSU's adjusted appropriated budget for 2009-2010 it is apparent that our tuition revenue will not meet budget projections. I believe two major factors have contributed to this: lagging tuition collections and a greater number of tuition waivers."

Like most things the truth is in the middle, here somewhere in between the story of Squanto showing the pilgrims how to plant corn and James Loewen's "white people are evil" version of history. The suggestion that Europeans purposely used biological warfare to eradicate the Indians is absurd and not supported by any facts. Likewise, the teaching that everything between the first Europeans and the Indians was like the depiction of the first Thanksgiving is equally absurd. History is obviously romanticized by those who write it in their favor. However, to suggest that the exact opposite is the truth is equally myopic.

In my opinion the only solution is to allow some fighting. Pretty much every junior and professional league allow it and so should college. Players enforce these types of situations themselves. This will never happen, but it is the only solution to the problem. The NHL seems to have figured it out. They must average at most 1 fight a game and their star players are not getting run at.

I think this deserves its own thread. I watched the game on FSSN and saw the hit perfectly clear. Luckily I was recording it and was able to view it several times. Being they recorded it live I cannot figure out how they claim they missed it and did not have the replay The WCHA needs to review this and suspend Marvin. That hit was complete bush league. There is no possible explanation from Marvin. His head was up. He saw the puck was gone. He saw Genoway was facing the boards. If the WCHA somehow fails to act and Marvin steps foot on the ice tomorrow we should see our first fight of the year tomorrow. Hopefully Genoway makes a quick and complete recovery.

WDAY Story I do not know much more than has been reported, but I do know Dr. Gattuso's wife died this past March at a young age. They have a daughter who is 3 or 4. I believe Dr. Gattuso has older children from a previous marriage as well. They moved to Fargo from Oklahoma and I do not think they have family in the area. This is a very sad situation, especially for the little girl. Hopefully there is some family that can take care of her.

I agree the facts that are out there support an Agg Assault charge and this guy should spend time in jail. I had not heard about the bystanders keeping him there - I thought the original story said he voluntarily stayed. Given the recent messed up investigation/prosecutions in GF it makes sense they are keeping tight lipped on this.

This is not correct. You could be acquitted and it would still show up - the public records search is for court records, not criminal convictions. A deferred imposition of sentence is still a conviction anyway - the public perception about these is very mistaken. In MN they have deferred prosecution, which is completely different. I am not sticking up for the suspect, just saying all of the facts are not out there. I will hold off carrying the pitchfork and torch.

I was not trying to minimize the seriousness of the situation. However, Chwialkowski has never been arrested in ND or MN for anything prior to this incident (assuming he has not changed his name).

The media reported that Chwialkowski appeared in GF on a charge of agg assault, but unless they are having computer problems the only thing on his record is a speeding ticket. The only account of the incident I have read is from someone who was not there. It sounds like neither of these two are the type to be involved in this sort of behavior. I am sure alcohol is a contributing factor. I am sure there are two sides to the story and the truth will likely be somewhere in the middle. Eyewitnesses typically skew the facts in the favor of the side they know. One thing that appears certain is that Chwialkowski did not try to cause this type of injury. Had Smith not fallen the way he did this would be a case of B misdemeanor simple assault and probably would not have made the news.

Chapman and the Foundation are trying to push each other under the bus. Chapman claims he never tried to expedite construction on the house. I think there is likely a lot of blame to go around. From Terry Stroh to the Foundation to Chapman and his wife. How on earth did they not see having Mrs. Chapman on the building committee as a conflict? I graduated from NDSU and unlike many on this board I do not like to see this mess. I liked Chapman until his little stunt where he threatened to quit until the Foundation came in and started tossing money at him. From what I have seen it is unlikely he did anything illegal (I still do not see any evidence he had any kind of express authority on the house, implied maybe, but not express). Without seeing his taxes nobody can judge whether or not all of this in kind income was reported. Unethical is another can of worms. From my perspective he treated the Foundation like his own personal piggy bank. However, the Foundation allowed it. Some of the news stories are sensationalized, many are politicized, but what news stories are not? Chapman stepped on a lot of people and it appears they now smell blood in the water. It is hard to feel sorry for him for having to lay in the bed he made.
