  2. I've had to deal with Fargo media during a time in my life. I can confirm Teeder's takes on this subject. (When the reporter doesn't know what the ND Century Code is, much less says, you know there's a problem.)

And it's far easier to find a "no" excuse than a "yes". So unless there's a way to guarantee not ending up on the sanctions list, this effort can end up a net negative.
  4. Yes, but if and when an override vote were to come about, how will the landscape have changed? There's no guarantee all those votes will still be there.

  7. Now, for a quick sidebar: I'm amazed at how many don't know how something becomes law (called the Century Code in ND). In an effort to try to fix the apparent short-comings of either the schools or the learners here's an educational video about how a "bill" becomes law. (The transcript of the video is here.) Be aware however that this is written for US laws, not specifically ND, but the process is the same. To translate it: Washington or Capital Hill = Bismarck House of Representatives = State House Congress = Legislature Congressman* = State representative Senate = Senate Senator = Senator President = Governor White House = Governor's office * some will argue Congressman can mean House or Senate, but it's most commonly used for a House member.
  8. There, I believe, is the rub. Yes, the ND SBoHE has authority over UND's nickname; however, the ND SBoHE must also abide by state law (the ND Century Code). And there is nothing stopping the Legislature from mandating a school moniker. It's really no different than declaring a state motto ("Liberty and Union, Now and Forever, One and Inseparable"), state nickname (Peace Garden State, Rough Rider State, Sioux State), state bird (western meadowlark), state flower (prairie rose), or state dance (the polka?): it is their statement on how the state should be represented. If the Legislature says the moniker will be "Fighting Sioux" the ND SBoHE must live within that. The argument then becomes: Is this smart law? Will UND and the state see a net benefit from this law, or will we just keep litigating with the NCAA?
  9. Here's another one for our legal eagles to ponder regarding authority within the State of ND: The ND Century Code specifies that campuses in the NDUS, overseen by the ND SBoHE, are "dry". The ND SBoHE has to live within that. Who wrote the Century Code? The ND Legislature. So let's turn that slighty ... What if the campuses were not dry today and the Legislature passed a "dry campus" law. What would the ND SBoHE be able to say or do other than live within that law? I'm trying to sift through all the wheat and chaff in this conversation by asking these questions.

  11. Heidi? I'm not sure if that makes me happy or terrified. What I don't get is this: How can an organization made up of public entities (state universities, and some federal universities, like Air Force and West Point) and a few private entities (e.g. Notre Dame) that take federal funds, make a rule that is completely in conflict with The First Amendment? How can an organization that is majority public claim to be private?

  16. Right there in bold is the crux of this conversation. And right there is why I'm suspicious of a Fargo representative bringing it.
  17. 1. It says "Sioux" in the endzones of Alerus Center. That is the same as a logo in the eyes of the NCAA. 2. The sanctions are against the school, not its facilities. As it stands now, UND, if it keeps "Sioux", would not be allowed to host even if they spraypainted the end zones green* in The Al. 3. The net effect would be wholesale banning from UND's home fields as UND would not be allowed to host as the "Sioux". * comment here about turf being same as school colors ala Boise State and EWU.

  19. I watched some of the Red Menace of the West versus Goldie this weekend on the channel surf. They just didn't seem to have energy. They were disinterested against the border battle rival. I see UND, DU, UMD, and UNO in the top four. UM has the best schedule to finish fifth (MTU, @BSU). I suspect CC and UW will be battling it out at Kohl the last weekend for the last home ice and probably the right to host a CC/UW opening round playoff series.
  20. Actually, ... I believe if what you say happens (UND 39 pts), and CC gets a point or more at home v. UMD (making UMD's max 39), and UNO/DU split or UNO gets 3 points max (making DU's max 39 and UNO's max 38 or 39) ... ... well, figure out what to watch Sunday afternoon ... Basically, most simply, hope for CC getting at least a point and a DU/UNO split (or UNO with W&T). But it all hinges on UND sweeping. Control what's yours to control boys. Then go for a skate.

  24. Wait a minute here: At the SCSU mens game the official was sure SCSU had scored off the cross bar. He pointed. Yet he reviewed and the replay showed the entire puck didn't cross the line. No goal. At the UM womens game the official was sure UM had scored off a crease scrum. He pointed. Yet this guy doesn't review a melee in the crease? I could see the kick on the overhead replay on cable. So could 2888 in the rink. C'mon. Seriously. If you have the technology in place, use it. What kind of monkeys are running the WCHA and its officials? What's that you say? Bruce McLeod and Greg Shepherd? Nevermind ...
