Hey, with the expanded field UND may be able to host a playoff game!

There are two angles here for the SBoHE to mull over. 1) Their supposed constitutional authority over all Higher Ed issues. 2) Per the US Constitution, A state CANNOT legislate away it's contractual obligations. The problem is someone has to assert their rights under one or both of the above issues. Who should and when are political questions. We are nearing the end game for the anti higher ed cranks.

If the SBoHE is considering seeking injunctive relief, would they do it now or wait for election results?

I have no doubt that he is doing the work pro bono. Reed and his firm cashed in BIGTIME a number of years ago on a case against Canadian Pacific. He doesn't need the money.

State legally gave up on the name already. Everything else is just very annoying noise.

As I understand the Contracts Clause (from Con Law ten years ago) , usually the only thing that can alter a state's legally binding contractual obligations is a court decision. There is a test that allows states some wiggle room, but it is a high bar. A logo in a jersey wont cut it.

The notion that the SBoHE is alone on the "counterproductive" side here is laughable.

On a very positive note, this kid has a 3.6 GPA and a 1400 SAT. So, he would be automatically eligible for some level of UND academic scholarship. Can/do the coaches bundle athletic/academic when it warrants to free up dollars?
