As I recall (I was there), the first two were over the glove from opposite side forty feet out (not exactly great shots and very stoppable) and the third was between the pads and the pipe which is a pure goaltending mistake. But hey, I agree that one game does not make a career and everyone can have one - JPar did have a bad game against BC. I feel bad that his last college game had to end that way. I wish him well in the NHL and wish he were not going. He is still a damn good goalie.

  4. Very good point. The big sin committed by the NCAA is that they apply their standard in a capricious and arbitrary manner - a mortal sin in the world of law... Why is one school's use of native american emblems ok and another's is not?
  5. PCM, I like your arguments. They flow and conclude logically. I hope that is the prevailing argument. But you can be sure that the NCAA will take the position that it has a right, in its sole discretion, to protect the NCAA "brand" and if UND will not respect that right, it does not have to belong. I'm on the Board of Directors of a state-wide organization that uses the "brand" of a national non-profit. As such, that national organization dictates exactly how and when it's name and other trademarks, names, etc. will be used. I don't see this situation as being much different. Myles Brand (no pun) has already stated NCAA is prepared to defend its position (and brand). While I wish they would just leave us alone, I know we will have an uphill battle here.
  6. Scott's original post implied that there was nobody in ND that is qualified to do the work. I am not willing to summarily dismiss professionals working in ND just because that is where they reside. I too worked for over 10 years and received my training at one of the largest firms in the world (KPMG). I've now worked for over 25 years. When I crossed the border into ND, I did not lose that experience and knowledge. So I believe that it is possible that there is someone here in Fargo (or Bismarck or wherever) that could do the work. I can think of at least one person off the top of my head that might be qualified. Again, I'm not saying that is who should be chosen, but why dismiss them based on pure geography. Obviously, there are more lawyers in the bigger cities that are able to specialize in particular practice areas at the exclusion of all others (I'm currently paying a lawyer in DC over $600 an hour to advise on a very specialized issue). Scott's post painted the lawyers here as a group of generalists that do divorces one day and corporate transactions the next. That is not accurate and is unfair and unprofessional. Stating that the AG would choose the firm off the back of the phone book is an insult to the AG. So, I've said my piece on this now and I'm done talking about it. The real and most important issue is what are the chances of prevailing. Is this even a constitutional or anti-trust issue? (many of you arm chair lawyers seem to think so). I agree with all of the you that a hundred grand is NOT the number. So how much is it? And who's going to pay it? And what are our chances of prevailing? And is it worth it? If it's $100,000, let's go for it. But I would say (IMHO) that if it cost $1,000,000 to go forward with less than a 50 percent chance of winning, we're wasting our money and we should use it to choose a new name, design a new logo, procure new licensing agreements that last into perpetuity and devise a public relations campaign so that the new replaces the old ASAP...I know that is going to be a very unpopular position here so flame away...
  7. Yes, I'm sure that is the exact selection process. Again, we too dumb out here to realize the importance of the issue or the process we need to take so thanks again for your help and advise. That was a close one. I'm sure you've got great experience. I'm sure the size of your firm is every indication of its quality. The track record stuff is the Kool-aid I'm referring to when the big guys start justifying their rates. Thanks for helping make my point.
  8. Hey...I find your post to be the typical superior, city-boy attitude (Kinda how the Gophers play hockey alot of the time). Bigger is automatically better right? You seem to assume that if a person isn't smart enough to realize the benefits of spending three hours a day trapped in his car on the freeway or waiting 90 minutes for a table on a Tuesday, he or she can be much of a professional. We're just too dumb to realize how much smarter you big city people are. I see and hear comments like yours almost everyday when representing my clients. City lawyers talk down to me like I just fell off the beet truck. They tell their clients that the professionals out here aren't qualified. For the most part, it's a load of bull they sell to their clients so they can bill $600 an hour. In substance, it's not real except in cases where highly specialized knowledge is essential. Obviously, we would want a qualified lawyer to represent us but I highly doubt that the Sioux name issue is so complex that only a "big city" lawyer can handle it.

  10. I think it's "you're" as in you're a moron... not your... And while you spelled the word empirical correctly you obviously don't know what it means or how and when to use it. For your information, "empirical" is generally used in the context of scientific experiments and statistics, eg. empirical data. I doubt that you meant to say "experimental generalizations" unless, of course, that makes sense to you (and given your intended message, it may). Your lack of education is clearly evident in your spelling, word choices and especially in your knowledge of the facts. I think you'd be better off if you spent more time attending classes and less time posting pointless drivel on this board.

  14. Again, I am shocked, SHOCKED that a group that is as spineless as the NCAA could rule this way... The problem is that they might just be able hold it up in court since they will take the position that they, as a governing body, have a right to make rulings such as this and enforce them, no matter what. Their position will be that if UND doesn't like it, we can simply withdraw our membership...Of course, we believe that since they have a virtual monopoly and withdrawing is not an option, they should not be allowed to act in this arbitrary and capricious manner...or can they??? We'll soon see... Fighting Sioux Forever, w/ort the NCAA ruling. I'll always wear my jerseys to games and other events. No matter what...
  15. I think he was something like plus 10 over the last 11 games playing with Gionta and Gomez. He has really come on and has played extremely well over the past month. We should all be proud to hear "University of North Dakota product Zach Parise"...
  16. Here's hoping that you're right. But what's the point, your one season with Phil is already behind you. It's even money that they will both bolt the program anyway, Johnson even before he arrives. Likewise, we worry alot about Toews leaving. At least I do. As to your top five (and ten) pick bragging rights, I see that your other number five pick had such a great year...all he has is height and weight - Wheeler did not impress me at all. I doubt he'd go five again if that draft were to be re-held. So draft order, while having some weight, doesn't tell even half the story. Otherwise, we'd all be begging to trade Oshie (the 24th pick) for Wheeler (the 5th pick) and that's never going to happen...Wheeler couldn't carry Oshie's water... Finally, Kessel is a solid player with lightning speed and a good scoring touch. But he's a one-way deal and I've rarely seen him lay a check on anyone. He is definitely NOT a 17 year old in a 24 year old's body. I think he's actually afraid to go into the corner for fear of jeopardizing his draft status. If you've ever watched Ovechin play you've seen a genuine #1 pick, a two-way player who checks hard and often and can score at will. Toews is much closer to this standard than Kessel...

  18. Last Thursday after the BC loss, I had a chance to shake Mike's hand and thank him personally for all of his effort and the joy has given us over the past four years. Even though I'm sure he was very down about the loss and the team's early departure from Milwaukee, he took the time for me. I'm sure that he will do equally as well at whatever it is he does in life, in or out of hockey. He has the right stuff for sure.

  23. Paul was born in Fargo, but he grew up in Oregon. He is from a hockey family that includes both Potulny's (they are first cousins) and a brother that plays pro in the minors out east. In addition to Gaustad, David Hale is from Minot and is much more than anyone expected, earning a regular shift on D with New Jersey...Also, my understand (from acquaintances) is that Jason Blake was born in GF and played hockey there during his formative years...

  25. What a sweet scenario (for him, of course) it would be for JPar to get picked up by the Sens and, because of some freak injury or other reason, get to play in the Stanley Cup finals and maybe even win....that would be a Forrest Gump deal for sure...
