  1. If they beat the motion to dismiss, it will become quite interesting. You scoff. Good. I respect your abilities Scott and I did in law school - except you should have hooked up permanently with BA (very cute). The SL and SR nickname supporters have been underestimated every step of the way. Good to see that such a disposition is still prevalent.
  2. I would surmise this is good news for the lawsuit antitrust claims.
  3. Well, that was way off point but consider the source. If you're thrown in with JTA and Erich Longie, you're hopeless when it comes to "respect" for native americans or their voice but, I guess, hopelesslessness was already a foregone conclusion.
  4. The nickname and logo are not inimical to either UND or UND athletics. Rather, it's NCAA racism, intransigence, imputation of racism to a simple moniker, and arrogance that is the problem. If these alumni, including Phil Jackson who claims to respect native american heritage, were to press the 3 stooges (ND Congressional delegation) and publicly decry the NCAA's behavior and disrespect of native american traditions, it probably would have positive results. To eisegete doom and gloom into the term "Fighting Sioux" is a distortion. The NCAA, not the nickname, is the problem. These same public figures aught to be using their influence to point out how idiotic the NCAA's stance vis-a-vis a nickname with overwhelming support of at least one tribe is.
  5. Yes. Phil. He does not even like to acknowledge ties to North Dakota. A white rancher's kid trying to be a Buddhist aught to be offensive to someone.
  6. And, Hakstol's contract is up this year and Kelley and Faison hold the pen for the new one.
  7. Whether or not you think the credibility of the site is lacking, all you have to do is listed to McFraud's interview with Wanless on podcast. Pretty hard to make that up or exaggerate it. He basically contradicts Faison. http://www.kfgo.com/kfgo-podcasts-mike-mcfeely.php
  8. I don't agree with Rob Port on about 99% of what he says but he's no more of a gas bag than McFraud down in Fargo or Leigh Jeanotte or anyone else, except for me probably.
  9. Very astute points and couldn't agree more. All that the bungling by the SBoHE did was create a very credible basis for concluding that the "stakeholders" never had any intention to participate in and effectuate the terms of the surrender agreement in good faith. There was some solid support at SR and there were a few Tribal Council members sitting on the fence who could have been persuaded in favor of the nickname and logo. Archie and Steve Fool Bear and Antoine American Horse could tell you that. If you remember, (I can't locate it online and I am, therefore, paraphrasing here) SR basically asked the SBoHE and UND what their intentions were concerning the nickname and I believe that this was even after the May, 2009 fiasco following the SL vote. The UND Admininstration has wanted the name gone from day one of the surrender agreement and the surrender agreement itself was nothing more than a festooned 3 year "cooling off period" or buffer where half-assed attempts would be made and then everyone would just throw up their hands and would assume, by that time, that people would have just gotten used to the idea that the name would be gone. I can't believe that educated people could not make all of this less transparent, at least, and it's pretty difficult to believe that they really even tried to get approval or even that it was all just good faith bungling.
  10. That's a lot of garbage. He has nothing to be "accountable" for. He supports the nickname and logo and he has every right to state so and to do what he did. If you want to hold people "accountable" start with Leigh Jeanotte, Sharon Carson and the rest of the yahoos who have tried to creat "racism" out of whole cloth. Hakstol has no need to say anything.
  11. Precisely. No, you're not.
  12. I am the last person you want to make anything simple or explain anything rationally :~) But, my take is that this is a very stupid move. Maybe they get the law declared unconstitutional; maybe they don't. In any event, they make the liklihood of having a constitutional amendment enshrining the nickname more likely. Maybe they win the battle only to make things much more complicated further out and draw more national media. I do not agree with your perspective that keeping the nickname dooms UND athletics. The NCAA is holding a gun to UND's head for a very flippant and capricious reason: They just don't like the nickname and they feel that they have the power to just impose their will and monopolistic power on any school. It's pure ego and pure conceit. Many of you have bought into this distortion. The nickname and logo do not hurt anything. It is the sheer arrogance, conceit and mercurial disposition of the NCAA that is the real issue here. That is what is being challenged. The SBoHE, UND, Alumni, etc should buck up and emulate and join the Sioux people (yes, they ARE leading this - you can take that to the bank) who are fighting against this low-core aggressive juggernaut. All of you should be contacting the MIA congressional delegation and telling them to pull their heads out and intervene; what a trio of empty-suits. Tip O'Neill, a very bright former Speaker of the House, said that "All politics is local." If the tune of 17,000 signatures on a local issue has not garnered their attention, they're either being advised poorly or they're just obtuse. The Republicans should be especially concerned because this would tell me that a lot of people would be supporting more "conservative" or "libertarian-minded" opponents in any primaries down the road. The psychology being employed by the NCAA is quite transparent: It's economic terroistic threats, pure and simple. Many of you have acquiesced to it. It's no different than some petty fool threatening to blow up a building with a bunch of people in it if that petty fool's demands are not met. One can never cede anything to this sort of disposition. The economic terrorism reality aught to serve as a clairon call for overt, inflexible and unyielding opposition to the NCAA by everyone so victimized. Everyone is being victimized by the NCAA, especially the Native Americans.
  13. Even if it fails - and I'm not convinced that it will fail - the SBoHE has just made a constitutional amendment a much more likely prospect. Just plain idiotic, even from a petition supporter's viewpoint.
  14. I understand your points but the SBoHE is just plain being stupid here. They probably have a lower approval rating in the state than the U.S. Congress has nationally, given all that has transpired and given that there is a high degree of mistrust for the de facto fourth branch of government (lesislature and the citizens of ND) already. Now, they're going only to add to that by opposing the will of the voters? Sure, "we're just challenging the constitutionality of the law; we're not challenging the voters." Right. Even if they're sincere about that, do they really think that people are really going to appreciate or care about such an esoteric nuance? That representation is just going to fall on the ash heap with Shaft's unfounded Notre Dame comment and with the SBoHE hurrying up the nickname retirement in response to a favorable vote on Spirit Lake. I'm not a PR person but even I can see that whoever is advising the SBoHE needs to seriously think about making a career change. And, let's not forget that this little move will only add gasoline to the fire and quite possibly will result in more national media attention. So, in one fell swoop the SBoHE has 1.) caused resolve to become even more strong and passionate; and 2.) given even more fodder for national media. Capital move guys! Good show! Those of you on here who purport to have the interests of the university first and foremost and who oppose the petition process - and you do obviously have legitimate arguments/concerns - aught to be both stunned and incensed by this complete lack of foresight and utter absence of common sense. For once, Jacobs made a lot of sense yesterday with his piece. I guess it will be his turn to be Cassandra in this whole process.
  15. Very shortsighted of them to do this. Not surprising though. They've bungled every other part of the process so they may as well continue to do so. I'll say one thing for them at this point: They're predictable. Post-script: Oh, and they're incompetent and completely out of touch with how to accomplish a desired outcome.
  16. Thank you SBoHE. You just made the petitioners jobs easier......
  17. You can thank Leigh Jeanotte, et al and the NCAA, of course, and Roy Saigo for that. Leigh should just flat out be canned.
  18. Frank is a sharp, sharp guy. Who's opinion is based upon better quality information? Keep in mind Frank BC has been privy to a lot more on the native american side of this (multi-state wide) than Tim O'Keefe and possesses a perspective validated by FOIA responses. Not trying to engage in a who's smarter than whom argument but Frank BC is not an uninformed ninny by any means..
  19. I support the petition process and I don't fit into anyone of those groups, especially #2 "neo-con" reference.
  20. Amen! And, you're exactly right; it will pass I believe. ND people do not like a bunch of effete, smarter-than-thou knobs imposing this or that. And, you're exactly right in that it's the Leigh Jeanotte's on UND that have placed UND in this predicament. Blaming the people of ND is a distortion. Blame and hold accountable the few politically correct whiners that made this an issue in the first place. In Dickinson, a group of bed-wetters a few years ago tried to "persuade" the folks there to retire the "Midgets" nickname and were promptly told to pound sand. That's exactly what should have happened at UND. If you're pissed that UND is being held hostage, be pissed at those folks and at the NCAA who is holding UND hostage. All of this NCAA is a "voluntary private" club crap aside (which it is not), this is the psychology that many on here are acquiescing to. Much has been made here about making this a political issue, which it is becoming more and more. There are national media outlets picking it up and calling Eunice, etc for interviews. Instead of railing against people (Native Americans being victimized, no less) why doesn't everyone on this board call Hoeven's office and Conrad's office and Berg's office and tell their relatives to do the same thing? Cede anything to this sort of imperious, effete, it's our way (Jeanotte, Sharon Carson sp?) or you're dead mentality? NFW. To see this garbage on a national level, just look at Pres. Obama and his health care plan requirement forcing churches to pay the health insurance costs for things that run against their teachings.
  21. I don't know them but Roebuck is retiring and I'd lay a bet that his views have not changed one iota. As far as Hakstol is concerned, it's probably the same but he's married into the UND "mob" so his views must be muted at this point.
  22. Washington Times article (Who's "Gene" Shaft?): http://www.washingtontimes.com/news/2012/feb/8/with-referendum-fans-of-sioux-name-fight-to-save-m/?utm_source=RSS_Feed&utm_medium=RSS
