Res Judicata--Rule that a final judgment rendered by a court of competent jurisdiction on the "merits" is conclusive as to the rights of the parties and their privies, and, as to them, constitutes an absolute bar to a subsequent action involving the same claim, demand or cause of action. Definition is straight out of Black's Law Dictionary, I don't see the settlement agreement between the NCAA and the State of ND as having been rendered on the merits. Dooms dayers continue to spue Res Judicata as the bar against the second AG suit against NCAA, and further, I don't see the Federal Court as being barred from hearing the second case, I'm not so sure the second case couldn't be brought in State Court again. Legal experts in here want to set me straight? Moreover, I believe a clever attorney might couch his claims so they appear to be different than those previously brought in the original suit.
  3. How many times on this board have we seen "game over" regarding the nickname/logo? When the merchandising revenue is factored into the debate, it's a no brainer, you fight to keep the cash cow, that is essentially derived from the cash sport, i.e. hockey. I attend UND basketball games and UND football games, but really, Hockey is and always will be king in Grand Forks, and it transcends to the high schools here. Hockey powers year after year, basketball and football championship contention, what once a decade. The dreaded NCAA sanctions list, hmm, the doctrine of Res Judicata applying to the possibility of a second suit against the NCAA, but in Federal Court rather than State Court, not an absolute when dealing with distinct and separate sovereigns. I've been practicing law for 20 years, am part Sioux Indian, and believe the nickname/logo has always been used by the University to shed a positive light on Native Americans as a whole. The iconic nature of "Fighting Sioux" is worth continuing the fight and yesterday that message was sent loud and clear. I have never been convinced that Kelley, Faison, or the SBoHE members would be the determining voices on my beloved nickname and logo, and alas, they aren't. Thankfully, we don't get our inspiration from the U of M or the U of W, simply put, North Dakotans possess common sense, really the U of M and the team failures associated with it, maybe the NCAA should spend more of it's hypocritical focus on the schools of the Big Ten.

What I would like to see Kelley and Faison do is take a position that either believes in and stand on it, these two 'outsiders" should go into politics, since they both are so competent at speaking from both sides of their mouths, depending on which way the tide turns. Let's just see if the SBoHE members are so willing to protect their so called turf, I don't see them having the gonads to take on the majority here. North Dakota has spoken, no to political correctness. I am of sioux blood, my mother is a member of Spirit Lake, so you folks in here that think you've been speaking for the oppressed Indians, you've been fooling yourselves all along. Fighting Sioux forever....Been in Grand Forks since 1986, never once witnessed any of the hostility or abuse the Leigh Jennotte types keep whining about.
  5. Like I've always said, "The nickname and logo will be here long after Faison and Kelley are gone." Those two have to be looking at a different direction, or the majority will make sure they are ousted. Today, North Dakota said the hell with Political Correct Zealots, and yes, the vocal minority of the minority does not rule. Spirit Lake's vote does matter, vindication for Eunice Davidson, John Chaske and Standing Rock's Archie Fool Bear. Today, Majority Rules!

The AG's lawsuit against the NCAA will be in Federal Court and will include Intellectual property infringements, Gordie Caldis, GF Attorney was right all along, the original action should have been in Federal Court, with the precedent of the Central Michigan Chippewas being followed. Bring a constitutional claim if you dare SBoHE, those individuals know the overwhelming tide of distain that they will be forced to endure if they make that move. What a great day in Fighting Sioux History, what a great day for North Dakotans, and even more so, what a great vindication for the people of the Spirit Lake tribe.

  8. Common man on Kfan was discussing the other day that Patterson should be WCHA goalie of the year, because without him, the Gophers wouldn't be nearly as good as they finished. What is the kool-aid that the beat writers in the Twin Cities drink, one time just give it up to the Fighting Sioux, we lead in everything, Patterson is OK, but better than Dell this season, no way!

Let North Dakota be the place that said enough with the Political Correctness, majority rule, and you know what, the arguments that Gordon Caldis made with regard to trademark and copyright-intellectual property rights that the University owns in the logo and nickname have Federal precedent in action by other universities against the dreaded NCAA. Isn't that how Central Michigan is still the Chippewas, weren't they on the hostile and abusive list at one point also. Fighting Sioux forever.
  10. What if the new suit with the NCAA is in Federal Court and not State Court, then, is it not a different and distinct action, say like a Federal copyright/trademark action. Yes, the state court of Grand Forks County dismissed the suit with prejudice, but not the Federal Court. I do not believe we've reached the end yet.
  11. When the dust clears, and the money has spoken, I believe the nickname will still be here. Yes, I'm pro-nickname/logo, but this is the position I've always taken. If the Standing Rock Nation won't allow a vote, the State will, and believe it or not, the Standing Rock members (not all) are citizens of the State also, so their voices will be heard, along with the entire populus. Good or bad, it's on....

Reminds me of the 1998-2000 Sioux teams that were clutched and held every game throughout the seasons, then when the league decided to crack down on the clutching and grabbing, which team did they appear to focus on, suddenly the Sioux are the penalized team for all the holding. WCHA officiating is a joke, with the NFL a close second.
  15. Why does it always seem like Fighting Sioux players can get maimed, and then the league as a guise to make it right, ends up punishing the very team they assert they are trying to protect. The Malone situation is an absolute joke, charging, a two minute minor would have sufficed. The game is designed to be fast paced, players are taught to keep their heads up, and on a swivel, and you know what, accidents and injuries happen. No intent whatsoever in this situation, unlike Genoway's injury or LePoint's injury.

The petition being circulated at Spirit Lake by one Erich Longie will not result in a different outcome, the youth on the reservations tend to support the nickname and logo, they are more openminded than any of the anti-nickname fools. The youth will not be told how to vote and that since they disagree with the Ron His Horse Is Thunder, Jesse Taken Alive, or Erich Longie, they need to be further educated so their minds will be changed, that's Erich Longie's argument. Doesn't hold water, those individuals that are signing his petition, are the same individuals that voted with his bloc the first time, no large scale reversal. These fools are 100% afraid that the Standing Rock vote is going to mirror the initial Spirit Lake vote, I believe that the Standing Rock vote will result in an even larger approval percentage. So to you Best Buyson, the issue is not dead, it will be reconsidered, and we will be Fighting Sioux in 2010-11, 2011-12, 2012-13 and beyond, Summit League or no Summit League. This has always been about the loudmouthed minority of the minority, once the vote at Standing Rock takes place, these individuals will finally melt back into obscurity, without this issue to champion they have no cause. Not emotion, Fact!

This is the absolute downside to becoming DI and needing to get the leftover not quite up to par athletes, i.e., those that don't have freakishly great talent, but are still good athletes with defective charactor. Many of those athletes are left over for a reason, wonderful, both the Sioux and Bison get to recruit and land big city criminal elements, great for the communities and for the children that see them as role models. No one can argue with the simple fact that these are the type of athletes we will get to watch, myself, I've seen the big city kids and am not impressed. I would much rather watch some local fundamentally sound charactor athletes, but that's not what the big DI-AA will bring us. So not only won't the Sioux or Bison win national titles, but we will get subpar student athletes. Get used to the trend. I will take the drinking hell raising hockey boys over all the out-region athletes..

Absolutely right on point, anytime one wears Fighting Sioux apparel anywhere in the USA, that individual will be engaged by passersby and treated with honor and respect, that is not the case with our uppity cousins 75 miles south. Unless one has travelled the country and experienced the Fighting Sioux mystic, one will never understand, yeh, you Minneapolis/Bison and your ilk. Fighting Sioux forever! The march in support of the nickname last night was a real confidence builder, this is far from over...

The Bison sports programs have historically been riddled with theft problems, remember Jeff Giersch the basketball player, he stole spark plugs, remember the Dick family and the shoplifting from Dayton's department stores, and now we have the granddaddy of them all, the Best Buy theft ring, oh and I'm completely sure that these examples aren't the only Bison transgressions. Can hardly wait for the next Bison athlete to be arrested, will it be a simple chemical dependency issue or will it be major criminal conduct. I'll predict the latter. And hey Craig Bohl, if two players were involved, I'll bet there are more of your prized athletes that got dirty in this one.
  23. Last night I attended the opening of the Wacipi powwow, then at nine, I went and marched in support of the nickname. Archie Fool Bear and others from the Standing Rock reservation were at the front of the march, along with members of Spirit Lake. I have no doubt that a vote at Standing Rock will mirror Spirit Lake's vote. The SBoHE has now reversed the roles, the Indians are now the entities lobbying for the nickname and the majority of them need to be heard. This is not a done deal. Archie Fool Bear further explained the sacred 1969 pipe and prayer ceremony that gave the name to the University of North Dakota. Summit League or no Summit League, and SBoHE or no SBoHE, the Fighting Sioux will not be "officially retired", especially when the powers that be have already determined that the 2010-2011 year will continue to be the Fighting Sioux. This controversy is just shifting into the next gear, so Kelley and Faison take a deep breath, cause your politically correct personas are about to be tested. Kelley was present at the powwow, and he and his wife as honorees had to dance, it was killing him, his discomfort was obvious, what a phoney.
