  1. Your entire post was an irrelevant, emotional appeal. Much in the same way that the argument for keeping the nickname is. The point is that UND is not forced to do anything. It's all voluntary.
  2. Yeah but again, why should the court get the power? They should not get to have the ability to interpret law. If someone wants to make a law more specific than it reads as-is, then they should have to amend that law! It shouldn't get to be left up to some judge's interpretation!
  3. If NDSU's nickname was preventing us from getting into an auto-bid conference for all of out sports except football, you're damned right I would be okay with giving up the nickname. UND hockey fans should stop being so selfish. There is nothing wrong with being known as UND hockey!
  4. It's not the same because those were for-profit monopolies. The NCAA is a voluntary association. UND could go independent of the NCAA, if it wanted, too.
  5. Anyone else smell a Dan Hawkins to Colorado type situation for Kelly? That's too bad because the guy has done awesome things for C Michigan and Cincinnati programs. I think UC has the momentum rolling and will continue to build on what they've done so far. I, personally, want to see Notre Dame continue to lose so that NBC will drop their TV contract which then forced ND to join a conference. I can't stand ND thinking they are too good to join either the Big Ten or the Big East.

  7. It shouldn't be up to the judge to decide it!!!!!!!!!!!!!!!!!!!!! Why does a judge...one man....get to be so all-powerful!?! If the constitution does not specifically prohibit the SBoHE from an aspect of governing the state's universities, then it HAS the power, per the constitution. This should not be allowed to be "interpreted" by some court. If they want to change something, it should have to be a change to the constitution!
  8. You're only saying that because you don't want the SBoHE to be able to tell UND to retire the nickname. Another emotional appeal not based on logic or law. The SBoHE has the authority. If the court tries to take that away, they are in the wrong and should be punished for it. And by the way (not that I want to get into legal philosophy or semantics, etc. but..) what is the precedent/procedure/whatever whereby a court's decision is "thrown out" or decided to be incorrect? Because otherwise it seems like everyone (including politicians) are at the mercy of court rulings! As if we are just supposed to live with whatever the court rules as being the final say, forever?
  9. As I suspected, the tribe never had a legal leg to stand on. They're hoping to win something on a purely emotional appeal. The SBoHE has the authority to govern UND. Plain and simple. The SL tribe can't be allowed to take that away.
  10. Absolutely no doubt. 2010 will be the 3rd year of Bohl seniors. I don't see a lot of impact playmakers in this class either (or the Jr. class for that matter). Going to be another young team. If his kids can't get it done next year either...you will very likely not see Bohl coming back in 2011.

  12. So....the legislature is going to take away funding from the SBoHE..funding that is used to fund higher education in the state of North Daktoa...over a athletics nickname/mascot? If we were talking about the Mayville State Sioux, this would have never been an issue.
  13. The NCAA has never told the ND SBoHE that it can not govern UND in the way it sees fit. The fact is that UND voluntarily chooses to be a member of the NCAA's private club. They either choose to follow the rules of the private club or they don't. Nothing to do with the SBoHE. No precedent.
  14. No, it's not automatic. It never was and no one is arguing it will be. We're just saying that, assuming the pay structure stays the same, then the Summit stands to gain financial (along with every other conference) via increased tournament revenue if the contract increases in value the way most people expect it will. 82, you're not wrong...just most likely wrong.
  15. Of course I didn't mean the courts. The courts are just a tool, used sometimes by the unworthy to obstruct progress. The non-government entity I was referring to was the SL tribe. They have no place or business telling the SBoHE what it can and can not instruct UND to do. You may wish to argue that the SBoHE has no right to tell UND to do certain things...but that's not what we're discussing here.
  16. Ok that's fine...as long as there is some reasonable limit on how much time a judge may take to rule. Surely a judgment for anything other than the state would be preposterous and biased and dare I say criminally corrupted? There is no possible way that a non-government entity can strip away the SBoHE's authority to govern the state's institutions of higher education.

  19. Question: if the judge "decided" that he simply wasn't going to rule on this until Nov 2010...what is there legally to stop him? Could he be impeached or fired somehow?

  21. You're probably right about lower ratings, but that's not how it works. The network pays X dollars to show the entire tournament. Then the NCAA divides up the amount it gives to schools by 96.

I think whoever wants the tournament the worst (probably ESPN) is going to have to pay at least enough more to guarantee that each of the 96 teams gets the same sized slice as each of the 65 teams was getting previously. The NCAA should negotiate for that, at a minimum. But I think they could still get more. People go crazy for March Madness.
  23. Well then, if the regular season is so important as to decide which teams should and should not to the conference tournaments, then why have any post season tournaments at all? Let the team with the best record after the regular season be crowned the national champion via polls and rankings. So obviously you see the argument goes both ways. I think it's clear, however, that people want some sort of tournament to decide the national championship and that not every single team in NCAA DI MBB should get to be in that tournament. Then, making a logical case for 32, 64 or 96 is rather moot. It comes down to a personal opinion about which number of teams is "best". And as such, my personal opinion is that 96 is "best" as it gives the conference the best chance to get more than a single team in and the additional "slice of the pie" money that comes with that.
  24. Not really. The only impressive things about the FB facilities relative to the rest of NDSU's athletic facilities would be the Fargodome itself, the Coach's offices in the Fargodome and the auditorium in the Fargodome basement (with "NDSU football" on the chairs and walls). The Dome was built by the city..for the city. NDSU football has grown and prospered (for the most part) in the Dome. The coach's officies are 100% first class all the way. They rival any coach's football office complex in the nation (that is not an understatement at all). The auditorium is the same way. Everything else about the NDSU FB facilities are average to above-average compared with FCS. The football team has no special weight room or study area. They use the same as all other teams. My new dream for NDSU football is to see a 25k outdoor stadium built where the current "R" lot is (15th and Albrecht) that has one of those end-zone football facilities with everything in it. Something like what Northern Illinois has.
  25. Yes...17th? or whatever ave that is looks much better since they rebuilt it a few years ago.
