    The evidentiary rules, finders of fact, and burden of proof are all vastly different in the admin proceeding vs. a criminal case.  The standard to charge him criminally would be much more analogous to the final admin burden.  The alleged victim does not charge anyone, the State (or Feds) does.

    I'm making no statement about Otis, but when anyone comes before an administrative tribunal the odds are incredibly stacked against them.  When the situation involved an institution of higher education, the odds get much much worse.

    This. I feel for anyone who may have been a victim, but there has been a lot of confusing Title IX hearings with what happens in a criminal prosecution. There is a much higher burden of proof in a criminal prosecution.

    Additionally, it's easy to criticize the University of North Dakota, but the details of Title IX investigations are not made available for public consumption for good reason. In 2006 the names of 3 high profile Duke athletes (who actually were criminally prosecuted (wrongfully)), were drug through the mud by Duke faculty. Duke ended up settling with those young men for $60 million. Weah has not been charged with a crime, and most likely (at least at the time) had a much higher earning potential as an athlete than 3 lacrosse players. Add to it the optics of a young black man, being accused of a sex crime in lily white Grand Forks, North Dakota, and it could have been a 3 ring circus with a potential for huge financial ramifications for UND. I think UND handled it appropriately. Weah, unfortunately, chose the path of very public revisionist history, and it royally backfired.

    5 minutes on this message board, or researching him on social media, could've saved their program a lot of egg on the face.

    Idaho and Northern Iowa managed to add some natural light to their facilities, and basically had the same excuse not to. There's always going to be a facility war in the MVFC, adapt or die.

    That's a good post. I mostly agree with the entirety of it.

    I wish Mr. Weah would have been a little bit more careful with his comments on his former school but in the end I'm not sure it means much more than a little message board fodder in the summer. 

    The objections and holier than thou attitude of the entire Springfield media, and trust me, it is more than just a few, is something they will have to correct because we are about to be hated through most of the Valley. People don't respond well to the johnny come lately who is decidedly new money and it doesn't help that Petrino's team is darn good and carries themselves with an old school late 80s, vintage Miami feel.

    I think Bubba Schweigert is one helluva coach. But he hasn't won the Orange and Cotton bowls, hasn't been an NFL head coach, and hasn't developed a Heisman winner like Bobby Petrino. If you had the choice and threw out all of your nostalgia and personal feelings for UND, which one would you choose if you were trying to make the NFL. If it was me I'd head to the Ozarks and play for Bobby Petrino.

    Imagine you were an elite junior hockey prospect. Would you choose to go to Nebraska-Omaha or develop under the tutelage of Brad Berry? I'd opt to be a Fighting Hawk. I mean unless the Gophers offered or something like that.

    I still have more respect for your program than NDSU but I am pretty fired up about our game in October now. Bobby is an exceptional motivator and I have to believe that all of these comments will make the bulletin board in Springfield and will give our boys extra fuel in the Fall.

    The register of actions on the Supreme Court website has a DOB of 1999. So, either 23 or soon to be.

    Who cares? It's fun, meaningful football. Rather watch a team scratch and claw to make a quarterfinal than sleepwalk through the Meineke Car Care Bowl. And at some point, there will be an upset.

    You can say that about a lot of levels of college football. Mount Union was impossible to beat until UW-Whitewater and UMHB came along. There has been decent runs in DII with North Alabama, NWMSU and GVSU. FCS...well, there's that. And FBS has Bama as the perennial team to beat, but every few years someone figures it out.

    I don't think it would be a joke and 12 teams would make the playoff way more meaningful and inclusive. Who doesn't love an underdog? loved seeing Cincinnati get a chance, and honestly, they didn't fair any worse than other P5 schools or Notre Dame in years past. 

    That said, Izzo calling UND fans "rubes" is pretty rich. They've never played a full FBS schedule. They'd fair okay in the Mountain West, but let's not get ahead of ourselves here.

Anyway, I did post about UST potentially going D1 and that was rejected as a possibility as they were D3 (this post must have been on a throw away account a long time ago, as I don't see it anymore). So, I don't really post based on conjecture. I did also opine on the black curtains at the NDSU game being idiotic.

    Then I will win $1,000,000 from UND-FB-FAN. :D Seriously though, he's a very talented back but I just don't see enough there where a P5 school (who is absolutely going to put him through the vetting process) is going to say, "Gee, this kid who fumbles in big spots with limited eligibility and potential academic and legal issues (he failed to appear in municipal court for a DUS recently) is worth one of our coveted scholarship spots." Especially when you can put an 18 year old kid with a clean slate and no real ego (yet) on scholarship and try to mold him from a football and character stand point. Otis has seemingly shown an unwillingness to adapt to the culture of a team who by all accounts has a great culture, why would would a P5 school bring in a FCS headache? Otis won some conference and national recognition, but we're not talking about Randy Moss at 1-AA Marshall. 

    Maybe it works out and he gets a (FCS or FBS) scholarship, but I could honestly see him landing in the NSIC.

    He will get a FBS shot at a MAC school which is a lateral move. I didn't see enough in terms of pass catching, blitz pick-up or ball security for me to think a P5 is going to put him on scholarship, especially given his academic issues. Maybe the U will kick the tires on him and offer him a roster spot, but I don't know that he sees the field much in that situation. 

  16. I'm sure the black curtains on the catwalk have been mentioned before, but seriously, what the hell? They used up 50 yards worth of real estate and there was maybe a handful of media people in there, and almost nobody in the NDSU designated area.
