  1. Yes, an enter the lawsuit for being fired for expressing that opinion.

    There is a limitation on Hak's freedom of expression. He can't say and do whatever he wants. If he actively lobbies for a cause that harms the university and stands in the way of the university's long-term vision of what's best for its athletic department, he is no longer just expressing his opinion and he can be fired for being a cancer. I am not saying it will come to that, but he's going to have to get in line with what's best for the athletic department.

  2. Jedi if you think Hakstol is going to get fired from UND you're really not up to date on UND athletics. Hakstol has taken his teams to Five Frozen Fours in seven season he isn't going anywhere.

    I said I think Hak is a great coach and I like him. However, I don't think he is irreplaceable because UND has an elite college hockey program -- a tradition that started long before Hak came along. Hak is not a God.

    Hak is not going anywhere and neither is Roebuck. Those 2 guys have been the most vocal on the Sioux name out of the coaches of the major sports. If they fire them based on opinion only then there are major problems at UND.

    Of course, Hak is entitled to his opinion. But he can be legitimately fired for being obstructionist and acting outside the best interests of the University of North Dakota. IMO, the e-mail campaign he initiated in support of Al Carlson's legislation was purely about men's hockey. If he cared about other sports at UND, he wouldn't have done it.

  3. Hak is probably going to be disappointed, just as are thousands of loyal Fighting Sioux fans.

    But the coach is also a pretty smart guy who surely understands what is at stake now for the rest of the athletic department.

    I like Hak, a lot. I think he's a great coach, but UND has an elite college hockey program and he can be replaced. If he can't get in line with what's in the best interest of the entire school, he needs to go.

  4. Dear Mr. Shaft,

    Please ask the SBoHE to direct UND to resume the retirement of the Fighting Sioux nickname tomorrow. The lawyers can figure out the rest later. Anything else screws up the Big Sky and/or a year of recruiting.

    This is exactly what needs to happen. I e-mailed the members of the state board on Monday asking them to do just this. I was really disappointed to hear that Shaft didn't seem to want to do anything until there is a face-to-face with the NCAA and half the State of North Dakota (based on his comments with Scott Hennen). The SBHE/Legislature/Governor/REA have no leverage to use if such a meeting takes place except a poorly drafted law that is arguably unconstitutional.

  5. If Al is such an idiot, why did this bill pass? I'll tell you why. . . . because everyone in the legislature with any ties to UND voted for the bill, that's why. Those people that voted for this bill had the same opinion that 95% of people on this board had, "what a great idea for UND, a state law seals the deal"!!

    So, now Al Carlson's and idiot? Does that make 95% of the people on this board idiots, and a majority of the state legislators that support UND idiots too? I guess so.

    Within two weeks everyone on this board went . . . from great idea, to Al Carlson a bumbling idiot. Boy is it easy to talk out of both sides of your mouth. Introducing a bill that everyone thinks is a bad idea, does not get passed.

    Someone already pointed out that this is false. I think it is important to add that State Sen. Mac Schneider, who was a part of the UND football team that won a national title in 2001, was very outspoken is his opposition to the nickname law. You can read the his committee testimony here.

  6. First I want to say that I am will be sad when the Fighting Sioux name is goine. My dad played BB for UND, I have been a Fighting Sioux fan since the '60's. As a fan of the University of North Dakota, I don't want the athletic department and for that matter the entire university dragged through the mud and slime for years to come. The Big Sky has threatened to not allow membership, Minnesota and Wisconsin will not play UND, and others will follow. UND would likely be an independent and stuck on an island in the arctic. Sica use of the word pariah, will be pretty accurate.

    There is an SBoHE this meeting this Thursday in Minot. Action needs to be taken.

    Jon Backes (current Board president) and Grant Shaft (Board president July 1st) are both UND law school graduates and I'm sure will get this moving, with all that has transpired in the past few days.

    The SBoHE needs to take control of the nickname issue back from the legislature. Constitutionally, it IS theirs to control. They need to advise Dalrymple and Stenehjem of their intent, so they are not blindsided (I doubt that they would be, but courtesy would dictate advising).

    The SBoHE then directs UND to retire the name. UND will follow direction as stipulated by the SBoHE, as UND is under their authority.

    Yes, this likely head to court, but better sooner than later.

    What won't happen?? The NCAA is not going to change their mind. They are not going to allow a law passed after a settlement agreement was made to force them to change their mind. It won't stand up legally, so they have no reason to back down. They will continue to point to the settlement and say they are done with the issue and impose sanctions, should UND maintain use of the Fighting Sioux name.

    I am a fan of the University of North Dakota and will always be, no matter what the nickname is.

    I agree that this is the best course of action at this point.

  7. It doesn't take a law degree to understand that, based on the law, the agreement is now illegal and can't be enforced. The NCAA will be breaking the law if and when they try to uphold the terms of agreement.

    From a legal standpoint, this opens up the door. So, you want to deny/rescind membership in the Big Sky because of what we call ourselves? And, you say that it's the NCAA's policy that you're following? Alright then, let's have that fight and I'll bet the farm on the First Amendment. Wayne, here's your encore invitation. Let's get going. This UND alum is ready with checkbook waiting.

    The First Amendment applies to the government, not private actors like the NCAA and the Big Sky Conference. You would lose the farm.

    What happens then is the NCAA gets laughed out of the courtroom. The law voids the prior settlement. Once that law takes effect in August, the settlement for all intents and purposes never happened in the eyes of the law. The NCAA has no idea what they're dealing with.

    What is the basis for this statement? The law does not void the settlement.

The point is that the whole policy has been idiotic from day one and there should never have been a need for a legislative vote, there should have never been a need for the Big Sky to write this letter, there never should have been a need to have a lawsuit. It's crazy. Plan B should be to have Hoeven and Berg (Conrad's a lost cause -- always has been and always will be. Mark Andrews: You were sorely missed and I will always be pissed at you for suing the Fargo doctors) start talking to the NCAA. Time to get the computers hot with emails again.

    Yet, no matter how idiotic you think the NCAA policy is, the organization has no reason to change it. The lawsuit settled. Game over. If the legislature had taken the time to consult a competent, unbaised attorney, it would have been made clear that the new law is arguably unconstitutional and it encourages a lawsuit that is barred by a release of claims contained in the settlement agreement between the NCAA and the State/UND.

    As far as your Plan B goes, if you think Hoeven and Berg are going to step up on this issue, you are going to be waiting a loooooong time. Hoeven has never stuck his neck out on a controversial issue.

  10. Just got around to reading the Sports Illustrated article on the Ohio State tatto for logo/Buckeye merchandise scandal. Once again, the NCAA allowsa national championship to be negated by big time university scandal. The corruption that continues under the watchful eye of the NCAA, oh but have a sterling DI hockey team with an Indianhead logo that goes to the National tournament annually, lets spend our focus there....As for me, the NCAA does not dictate what is hostile or abusive, it does not define the iconic history of our region, and it certainly is no one's moral compass. I again recently purchased Fighting Sioux Hockey Season Tickets, and pumped for another run at the WCHA McNaughton Cup, and the WCHA Final Five's Broadmoor Trophy, and a National Championship.

    The NCAA hasn't focused on UND for a while. The lawsuit settled years ago and the NCAA declined the opportunity to come to ND to revisit the nickname issue. The NCAA has moved on. It's time for UND to move on too. There is too much going for UND sports right now to let the nickname hold the school back.

    Sorry bro, the NCAA calls the shots here. The State/UND agreed to settle the lawsuit against the NCAA. UND didn't get tribal approval and now the nickname must be retired.

  12. yes, UND released all claims in the State jurisdiction, but that settlement agreement does not preclude a Federal suit, nor is it binding

    on any Federal court.

    All claims means all claims. Do you really think the NCAA's lawyers agreed to terms that would allow UND to relitigate this thing? No.

  13. So what would be the charge when the state files a lawsuit against the NCAA? Will it be antitrust or would be violation of state law??

    Read paragraph 1 on page 2-3 of the settlement agreement. The State/UND released all claims that were brought or could have been brought in the litigation.

  14. #4 UND lost the lawsuit because they didn't have tribal support that the NCAA felt was acceptable even the Spirit Lake's support of 2000 wasn't good enough but now with the SL signed written permission with the tribal vote, plus the state law gives the school a lot more ammunition over the NCAA that we didn't have in 2007.

    The State didn't lose the lawsuit. The parties agreed to settle it without further litigation.

  15. I remember ESPN covering the Sioux nickname issue 3 or 4 years ago with Bob Lee. With all that is going on now, why no mention? Not even on ESPNNEWS? Are they afraid if they do a story it will expose the NCAA as hypocrites? Hell, this would make a good story for Freedom Watch. I'm sure Judge Napolitano would be proud.

    People outside of North Dakota probably don't care about this debate anymore.

    But why do I care about supporting UND? I'd rather see all of these schools support themselves by selling a product (education) to students (customers) who need it. I know that sort of market-driven common sense is distasteful to those in the ivory tower, but subsidized higher education is heading for a big collapse.

    True story, believe it or not. Also, I am pretty sure the people who put together the Forbes rankings you cited don't do a lot of hiring. The only thing that matters is what employers think of UND. In my experience as a UND alum, people think UND is a solid school.

    Your comments about supporting UND show that you are obviously on this board to spout off your extreme conservative agenda. I'm not against healthy criticism of the university, but your BS crusade against state funding of higher education is better left on your blog.

  17. Ha, so things like graduation rates don't matter? How about this: Forbes ranked both UND and NDSU, these supposed world-class universities, below 500 nationally.

    But we never hear about these things, do we? We always hear about new buildings being built and record-breaking attendance.

    By the way, my personal observations don't matter (and neither do yours) because they are mere anecdotes and not at all useful in a sound analysis based on facts.

    In my experience, as an alum, the University of North Dakota has a solid reputation regionally. I have never, ever heard anyone with whom I have interacted professionally say either UND or NDSU is a mediocre school.

    By the way, Mr. Port, are you on this message board to support UND or to spread your extreme conservative ideology? If its the latter, you really should stick to blogging.

It would seem from this thread some of the Sioux fans are much more desparate for this game than any of our fans are.... :silly: Especially if you think the goofs at the legislature ought to mess around with this. The best thing the folks in Grand Forks could do is boot that idiot Cory Mock out of office.......

    I assume most fans from both sides think it is outrageous that the Bison and Sioux don't play each other. Your comment about the legislature staying out of this is akin to saying "keep your government hands off my Medicare."

  19. Why should the legislature not put pressure on two STATE schools? Any amount of cash either UND or NDSU would get from playing an FBS schools is trivial compared to the STATE money both schools get. I'm sick of both UND and NDSU letting egos get in the way of rivalry games. If the legislature needs to step in, so be it. The ADs at both schools have had more than half a decade to figure this out. Time's up.

  20. I'm not sure of any Sioux hot spots. We'll be at the Nitty Gritty Bar near the Kohl Center and the Great Dane Pub/Brewery near the capital.

    Seems like a lot of people are planning to hit up the Nitty Gritty Bar. I've talked to some other people who are going there too.
