A: About the same, maybe less, than they care about laws passed in the ND Legislature.

If Spirit Lake is serious they'd be in US Federal District Court seeking injunction.

Wow- proof again that this name matters to a lot of the Sioux Nation and I'm grateful for their support and will to fight. A federal lawsuit will get a lot of attention and maybe some real change. Hard to argue the Spirit Lake Sioux are oppressed by the Sioux name and logo attached to North Dakota's flagship university.

Which is something they should have done 3-4 years ago. Even if they went to the US District Court, I'm not sure they'd have standing to get an injunction. It's a nice gesture, but probably too late to forestall the name/logo retirement.

Yeah where were they 3-4 years ago, now I don't know if it matters at all. As we have found out the NCAA has the lawyers and the money to wait just about anyone out.

If they raise the money, Spirit Lake may go after the NCAA in Federal Court on discrimination charges. Based on the NCAA's arbitrary rules, Spirit Lake could easily prevail against the NCAA, but it would take a large amount of $'s and time. That's why they need an injunction.

Interesting that Spirit Lake wants to take possession of the logo: UND brass must be sick over that item. :D Kelley is going to do his damndest to ensure that the Sioux logo merchandies can never again be produced after retirement. If Spirit Lake gains that right - don't be surprised if the legislature forces the handover of the logo to Spirit Lake - the Sioux logo would continue to sell for years and years, giving Spirit Lake a nice annuity. Meanwhile, the new UND logo won't sell, not even to the PC crowd, who only buy ND or UND-notated stuff anyway.

The whole state political establishment isn't liking the idea of a nickname initiative referendum either. The portion of Standing Rock in ND will be forced to vote, making Standing Rock's leadership stand on this issue untenable. The state legislature may also require a vote prior to any retirement.

No matter how badly the state of ND, the NDUS, and the NCAA wanted to kill the Sioux nickname, Fighting Sioux will live on in the hearts and minds of the people.

Strange how the resdient PCer's on this board aren't demonizing Spirit Lake - who are going down a much more radical path than Al Carlson ever did. Carlson has been crucified on this board. Why does Spirit Lake get a free pass?

That would be interesting.

Let's say the Sioux name at UND is retired.

Spirit Lake then, somehow, takes ownership of the logo/artwork. Then, they sell that logo/artwork with green/black/white colored sports clothing simply saying, "North Dakota". Maybe even a "Fighting Sioux" under it. No mention of "University".

Oh, wouldn't that be great! :D

Because the Spirit Lake band doesn't have a cynical agenda to usurp the state constitution for its own political gain? :glare:

So why doesn't Spirit Lake go down to Standing Rock and rattle some cages?

I have always wondered that? What if the tribal council went to Standing Rock to meet with their tribal council could something have been worked out? I just wish this was during the 2007-2010 timeline then maybe something more could be done.

Sitting Bull was killed while being taken into custody on the Standing Rock Reservation by a BIA officer named Marcellus Red Tomahawk.

If you've lived in ND you know Red Tomahawk: He's on the state highway signs and the doors of the ND Highway Patrol cars.

Red Tomahawk was Yanktonai (paternal) and Hunkpapa (maternal). Sitting Bull was Hunkpapa.

Standing Rock has to this observer been disagreeable (crabby? obstinant? firm-minded to a fault? I'm trying to be nice) from the days of Sitting Bull and before right through more recent times. Call it Sitting Bull's legacy.

It'd only be good in US Federal court. As far as the rest, under the highly unlikely scenario of SL Tribe getting an injunction and ultimately win versus the NCAA, any school that's played Florida State, Utah, or Central Michigan (and probably Illinois as well) after Aug 5, 2005, really shouldn't be saying too much on subject.

He does have a minor point. However, I couldn't believe that if a third party sued the NCAA/UND/etc over this issue, especially a legitimate indigenous nation using the name, Sioux, it can do nothing but make the NC$$ look foolish. As long as UND/SBOHE/ND State Legislators go along with the plan to retire the name, what can the NCAA/Big Sky do to UND? It would just probably just open themselves up to litigation if they screamed foul or took action based on a third party's potential legal suit.

This could be fun. :lol:

If they file an injunction, the ND legislature might back away while legal action goes on for the next 3 years, thus cementing your sanctions and Independent afficilation with no conference. Yeah, what a great thing for UND. You didn't see the ND Law thing as anything but good until it smacked you in the face. Now this, you simply can't get out of your own way. This board must represent a 1% minority opinion, beacuase I simply can't believe that anyone with any sense would see this as positive.
